2.0 Statutory procedures for carrying out “Minor Works”.
2.1 Existing “obtaining approval and consent” process (BO14):

n Carry out works on site

8.0 Other Legislations (TG on MW Ch10)
1) Allied Regulations of BO
n BO, design manuals, PNAP, PNRC & JPN
n B(C)R3 and APP-53 - The “Certificate of Accepted Building Materials and Products for Minor Works” and “Schedule of Building Materials and Products for Minor Works” should be submitted in accordance with APP-13 and PNRC25. (e.g. fire resisting product, glazing barrier, cast iron pipe and other)
2) New Territories Exempted Houses
MW control does not apply any building exempted under Buildings Ordinance (Application to the New Territories) Ordinance (Cap. 121) as specified in a “certificate of exemption” s7(1). Submission should be made to DLO.
3) Town Planning
OZP for controlling the use, density, viz plot ratio, site coverage, gross floor area and height of the development under the Town Planning Ordinance (Cap. 131).
4) Airport Height Restrictions
The Hong Kong Airport (Control of Obstructions) Ordinance (Cap. 301) also provides for controls of heights of buildings in the interest of the safety of aircraft.
5) Fire Safety
Obstruction and locking of MOE under Fire Services (Fire Hazard Abatement) Regulation (Cap. 95F) s14 and 15. When installation of metal gate at the entrance of building,
(a) any locking device proposed should be readily opened from the inside without the use of a key at all times; and
(b) if an electric locking device is installed, the device shall be released automatically upon power failure and be fitted with a power on / off switch for testing.
6) Environmental Protection
6.1 Noise Control Ordinance (Cap. 400) s6 to 8 and 8A control construction noise in designed area, 7pm to 7am and general holidays by Construction Noise Permits. Contractors may check the “Code of Practice on Good Management Practice to Prevent Violation of the Noise Control Ordinance (Cap. 400) (for Construction Industry)”
6.2 Waste Disposal Ordinance (Cap. 354) s16 and 16A provide for the control on illegal dumping of waste. Contractors should arrange for proper disposal of construction waste at the prescribed facilities as provided in WD(CDCW)R3.
6.3 PNAP ADV-19 for “Construction and Demolition Waste”
6.4 Asbestos control provisions in Part IX of the Air Pollution Control Ordinance (Cap. 311). Building works involving asbestos must be conducted only by registered qualified personnel. Relevant manuals published by EPD:-
(a) “Code of Practice on Asbestos Control - Asbestos Work Using Full Containment or Mini Containment Method”;
(b) “Code of Practice on Asbestos Control - Asbestos Work Using Glove bag Method”;
(c) “Code of Practice on Asbestos Control - Preparation of Asbestos Investigation Report, Asbestos Management Plan and Asbestos Abatement Plan”;
(d) “Code of Practice on Asbestos Control - Safe Handling of Low Risk Asbestos Containing Material”; and
(e) “Code of Practice on the Handling, Transportation and Disposal of Asbestos Waste”.
6.5 Dust mitigation measures complying with the Schedule of the Air Pollution Control (Construction Dust) Regulations (Cap. 311R) should be adopted to minimize the dust emission.
6.6 Legal controls also apply to sewerage connections by means of the Water Pollution Control Ordinance (Cap. 358).
7) Heritage Conservation
n Antiquities and Monuments Ordinance (Cap. 53) (“AMO”) s6 restricts the carrying out of building works in a declared monument or proposed monument.
n Although the graded buildings are not under statutory protection under the AMO, demolition works or building works such as alteration or renovation which may affect their heritage value are not encouraged by the Secretary for Development (DEVB TC(W) No. 6/2009).
8) Construction Workers Registration
Under the Construction Workers Registration Ordinance (Cap. 583) (“CWRO”), the works described in Part 1 of Schedule 1 may only be carried out by registered skilled workers, or by registered construction workers under the instruction and supervision of such registered skilled workers. Example,
(a) asbestos abatement
(b) concrete repair
(c) curtain wall installation
(d) demolition
(e) mechanical excavation
(f) structural steel welding
9) Construction Site Safety
l Green Card - under Factories and Industrial Undertaking Ordinance (Cap. 59) s6BA, workers should receive recognized safety training and hold a valid certificate
l Construction Sites (Safety) Regulations (Cap. 59I) (“CS(S)R”) s38A & 38AA – Contractor shall ensure safety of the construction site, especially when working at height and providing access to and egress from the work place.
l Precautionary Measures for Construction Sites PNAP APP-107.
l Adequate steps such as working platform should be provided for prevention of falls at height of not less than 2m under CS(S)R38B.
l Prevention of falls into the trench or down from more than 2m under CS(S)R40.
10) Prevention of Bribery
l Soliciting or accepting bribes and presents in any form is forbidden under Prevention of Bribery Ordinance (Cap. 201).
